Limited license and restrictions on use

TIAA grants you a limited, revocable, nonexclusive, nontransferable license to view, store, bookmark, download, and print the pages within this Site solely for your personal, informational, and non-commercial use, or as expressly authorized by TIAA in writing. Accordingly, you agree not to:

You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to TIAA or its service provider for the duration of your business relationship, solely to help them identify you or your wireless device and to prevent fraud. Foreign investors

The Site and the Materials on the Site are intended to be made available only to individuals who reside in the United States. Limitation of liability

Tiaa will not be liable to you or anyone else for any consequential, incidental, special, direct, or indirect damages (including but not limited to lost profits, trading losses or damages that result from use or loss of use of the site and third-party content, inconvenience or delay). This is true even if tiaa-cref has been advised of the possibility of such damages or losses.

Tiaa will not be liable to you or anyone else for any loss resulting from a cause over which tiaa does not have direct control. This includes failure of electronic or mechanical equipment or communications lines (including telephone, cable and internet), unauthorized access, viruses, theft, operator errors, severe or extraordinary weather (including flood, earthquake, or other acts of god), fire, war, insurrection, terrorist act, riot, labor dispute and other labor problems, accident, emergency or a government action.

If you live in a state that does not allow the limitation or exclusion of liability or incidental or consequential damages, or if you access the site solely through an arrangement with your employer or plan sponsor, some or all of these limitations and exclusions may not apply to you.

Indemnification

Termination

The rights granted to you herein terminate immediately upon any violation by you of these Terms and Conditions. TIAA, in its sole discretion, reserves the right to temporarily or permanently terminate your access to and use of this Site at any time and for any reason whatsoever, without notice or liability. TIAA will not be liable to you or any third party for any termination of your access to or use of this Site.

Governing law

Unless otherwise agreed, these Terms and Conditions and their enforcement are governed by the laws of the State of New York, without regard to conflicts of law, and shall inure to the benefit of TIAA’s successors and assigns, whether by merger, consolidation, or otherwise.

Brokerage clients

TIAA Brokerage, a division of TIAA-CREF Individual & Institutional Services, LLC, Member FINRA and SIPC , distributes securities. 360˚ Financial View users

The 360° Financial View service is provided by Yodlee, Inc. Your use of 360º Financial View is subject to service Terms and Conditions to which you agreed when you first accepted the Service. We reserve the right to correct any error(s) with secure access inquiries and transactions.

TIAA Financial Consultation SMS Alerts

Note: Adding your mobile phone number to your financial consultation appointment allows TIAA to send confirmation, reminder, and cancellation alerts via text messaging which you opt into.

These text messages will occur upon registering for your financial consultation, 48 hours before your scheduled consultation, two hours before scheduled consultation, and also in the event you cancel your scheduled consultation. Text messages will not occur after your two hour appointment reminder. Only in the event that you opt in during registration for a future financial consultation will text messages reoccur. Alternatively, to discontinue receiving text messages prior to attending your financial consultation, text STOP to [54991].

We may also use this mobile phone number to call you regarding your financial consultation. There are available resources for deaf, deafblind, hearing and speech impaired participants; including Relay Services, TTY and Interpretive Services through TTY (1-800-842-2755, TTY: 711). Messaging and data rates may apply; contact your carrier about your plan. TIAA does not charge for this service.

Any personal information we collect from you is done with your consent. We safeguard it with physical, administrative and technical safeguards, and do not share it with any other party without your consent, except for fraud prevention purposes or in accordance with law.
